These Terms and Conditions (“Terms”) govern your access to and use of the FIDAR System Inc. website (fidarsystem.com) and the purchase of products from FIDAR System Inc. (“FIDAR System,” “we,” “us,” or “our”). Please read these Terms carefully before placing an order or using our services.

1. Acceptance of Terms

By accessing our website, submitting a quote request, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and all policies incorporated by reference, including our Privacy Policy, Returns Policy, Refund Policy, and Shipping Policy. If you do not agree to these Terms, please do not use our website or services.

2. Who We Are

FIDAR System Inc. is a Canadian B2B supplier of premium plastic sheet materials, including cast acrylic, PVC, polycarbonate, ACM panels, and mirror acrylic, supplying fabricators, sign makers, contractors, and industrial businesses across Canada.

3. Products and Pricing

All prices displayed on our website are in Canadian dollars (CAD) and are subject to change without notice. Prices do not include applicable taxes or shipping costs unless explicitly stated.

We reserve the right to correct any pricing errors, even after an order has been placed. In the event of a pricing error, we will contact you before processing your order and give you the option to proceed at the correct price or cancel.

Product images are for illustrative purposes. Colour representation may vary slightly from the actual material due to monitor calibration and photographic conditions.

4. Orders and Order Acceptance

Submitting an order through our website or by phone constitutes an offer to purchase. An order is only accepted - and a binding contract formed - when we send you an order confirmation by email. We reserve the right to decline any order at our sole discretion, including orders affected by pricing errors or stock unavailability.

For custom cut-to-size orders, it is your responsibility to verify all dimensions and specifications on the order confirmation before production commences. Once production begins, custom orders cannot be cancelled or modified.

5. Payment

Payment in full is required before shipment unless otherwise agreed in writing for approved business accounts. We accept:

• Major credit cards (Visa, Mastercard, American Express)
• Debit cards
• Electronic funds transfer (EFT) for approved accounts

Payment processing is handled by secure third-party payment processors. FIDAR System does not store full credit card details on our systems.

6. Taxes

All orders are subject to Canadian GST/HST. FIDAR System Inc. is registered with the Canada Revenue Agency under GST/HST Registration No. 705870947RT0001, and the tax is shown as a separate line on every invoice and at checkout.

The rate you pay is the rate of the province the goods are sent to, not the province you are billed in. This follows the Canada Revenue Agency’s place-of-supply rules. The current rates are:

• HST 15% for goods delivered to New Brunswick, Newfoundland and Labrador and Prince Edward Island.
• HST 14% for goods delivered to Nova Scotia.
• HST 13% for goods delivered to Ontario.
• GST 5% for goods delivered to Alberta, British Columbia, Manitoba, Northwest Territories, Nunavut, Quebec, Saskatchewan and Yukon.

Orders collected from our warehouse. If you or your carrier collect the goods from our North York premises, the sale is made in Ontario and Ontario HST applies, whichever province you are from. This is the same place-of-supply rule: the tax follows where the goods change hands.

Provincial sales taxes. We are registered for GST/HST only. We do not collect Quebec QST, British Columbia PST, Saskatchewan PST or Manitoba RST. If you are in one of those provinces you may have a self-assessment obligation to your own province, and you should take your own advice on it.

Orders shipped outside Canada. Online checkout serves Canadian addresses only. Where we do ship abroad by separate arrangement, the sale is a zero-rated export and no GST/HST is charged; any duties, import taxes or customs charges in the destination country are yours. Goods collected in Ontario are taxed in Ontario even where the buyer is not Canadian, because the sale is made here.

Rates are set by government and can change. The rate applied to your order is the one in force on the day the order is placed, and it is always shown before you pay.

7. Shipping and Delivery

Shipping timelines provided are estimates only and are not guaranteed. FIDAR System is not liable for delays caused by third-party carriers, weather, or other events outside our control. Risk of loss transfers to you upon delivery to the carrier.

Please inspect all shipments upon delivery. Visible damage must be noted on the carrier’s delivery receipt. See our Shipping Policy for full details.

8. Returns and Refunds

Returns and refunds are governed by our Returns Policy and Refund Policy, which are incorporated into these Terms by reference. Key points:

• Eligible stock materials may be returned within 14 days of delivery, unused and in original condition, with prior authorization.
• Custom cut-to-size orders are non-returnable and non-refundable once production has begun.
• Damaged or incorrect orders must be reported within 48 hours of delivery.

9. Intellectual Property

All content on this website - including text, product descriptions, images, graphics, logos, and page layouts - is the property of FIDAR System Inc. or its licensors and is protected by applicable Canadian and international copyright and trademark laws.

You may not reproduce, distribute, or commercially exploit any content from this website without our prior written permission. You may print or download content for your own non-commercial reference use only.

10. Warranty Disclaimer

Our materials are supplied as described in the relevant product technical data sheets. To the fullest extent permitted by applicable law, FIDAR System makes no additional warranties, express or implied, including any implied warranty of fitness for a particular purpose beyond what is expressly stated in the product specifications.

It is the buyer’s responsibility to confirm that any material is suitable for their intended application before ordering.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FIDAR System’s total liability to you for any claim arising out of or relating to these Terms or your use of our products shall not exceed the amount paid by you for the specific order giving rise to the claim.

We are not liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits or business opportunity, even if advised of the possibility of such damages.

12. User Conduct

You agree not to use our website to:

• Submit false or fraudulent orders or quote requests.
• Violate any applicable law or regulation.
• Transmit any harmful, offensive, or disruptive content.
• Attempt to gain unauthorized access to any part of our website or systems.
• Use automated tools to scrape or collect data from our website without our prior written consent.

13. Privacy

Your use of our website and our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Changes to Terms

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
